BLC Speaks out About Selective Approaches in State Procurement System

Aleksandre Bolkvadze, founder of BLC law company, talks about alarming tendencies in state procurement system.

The company has explored the existing situation in 2017 and requested due information from state offices and Ministries. According to the research, all state purchases in terms of legal services have been carried out in a simple purchase form and only international law companies have won tenders.

The examined decisions violate the law on state procurement, because the mentioned law prohibits a simplified purchase of legal services, Bolkvadze said.

Simplified purchase is available in two cases: when an economic agent owns any exclusive right and neither domestic nor international firms hold similar rights. Moreover, simplified form is acceptable in extraordinary cases, however, even extraordinary cases are not relevant in relation to legal services, Bolkvadze noted.

Besides the mentioned cases, the fact the Government promotes foreign companies violates the law ion competition, Bolkvadze said.
