Holder of Capital Bank Plans to Protect the Interests at the Constitutional Court

The plenum of the Constitutional Court of Georgia is considering a claim of Capital Bank, LLC ELOS B.V and Gilbert Richard (citizen of USA) against the Parliament of Georgia. The session is scheduled at 11:15 a.m.

The claimant party requests suspension of the disputed norm before adoption of the final decision, as it violates his property, free entrepreneurship and fair trial rights.

According to the disputed norm, in case of appealing the administrative act of the National Bank, it is inadmissible to suspend its action.

As of the NBG’s decision, adopted in November 14, 2016, operating license was canceled and liquidated to Capital Bank.

“In the process of inspection of the Capital Bank, the facts of illicit income legalization, as well as violations of the rules, regulations and instructions of the National Bank of Georgia and international banking norms have been identified”, – the NBG said.
